What is H-2B & H-2A Visa Program?

H-2B Program (Non-Agricultural)

The H-2B visa program is available to all types of employers and helps them take care of the recurring short-term, peak load, or special event based demands for additional workers.


The program allows non agricultural businesses to obtain foreign labor to fill temporary or seasonal positions. Under the H-2B Program, foreign workers are hired on a seasonal/special event basis and then return to their country of origin when the season/special event it's over.

To qualify for the H-2B or H-2A program the employer must establish that:

  • Its need for the prospective worker's services or labor is temporary.
    (The employer's need is considered temporary if it is a one-time occurrence,
    a seasonal need, a peak-load need, or an intermittent need.)

  • That there are not sufficient U.S. workers who are able, willing, qualified, and available to do the temporary work.

  • That the employment of H-2B workers will not adversely affect the wages and working conditions of similarly employed U.S. workers.

  • A single, valid temporary labor certification from the U.S. Department of Labor (DOL) must be submitted with the H-2B petition.
